The never ending legal saga between Apple and Samsung continues. San Jose Mercury News reports that Samsung has asked the U.S Federal Circuit Court of Appeals to reconsider the central part of a recent ruling that had upheld $548 million in damages for copying Apple’s patents.

Samsung urged the U.S. Federal Circuit Court of Appeals to rehear the case with its full 12-judge roster, arguing that a three-judge panel erred earlier this year when it left intact a jury’s verdict that the South Korean tech giant’s smartphones and tablets infringed on Apple’s design patents.
That part of the verdict — which has been pared from an original judgment of $1 billion — accounts for about $400 million of the $548 million in damages Samsung still must pay Apple from their first trial.In 2012, a jury had ordered Samsung to pay $1.09 billion in damages for willfully infringing on Apple patents in 23 products. This was later reduced the damages to $900 million after the judge found that the jury had miscalculated the damages due to a misunderstanding of patent issues.
Last month, the Appeals court had ruled that Samsung had infringed on Apple’s design and utility patent but wasn’t in violation of “trade dress”, and therefore didn’t owe as much as previously awarded by courts. The U.S. Appeals court had reduced the damages from $932 million to $548 million.
